3.03 – Mind Games

Synopsis:
Gibbs is ordered to get a convicted serial killer to reveal where the bodies of his victims are before his execution. When his first plan doesn't work, Gibbs must use his own gut feelings to persuade the man, but more recent victims are found by the team which leads to another disturbing direction.

Episode Recap:
A prisoner under armed escort is directing the search of an old barn. He indicates the loft where a container of human tongues is found. The warden is upset, the prisoner had promised this was the location of his victims' bodies. The prisoner says that if he can talk to the person who put him in prison, Leroy Jethro Gibbs, he will divulge everything.

Agent Paula Cassidy is in the squad room looking at the prisoner's arrest sheet. She recalls how she was a junior at Georgetown 10 years ago when Gibbs caught Kyle Boone. Tony comments that the fear Boone created must have made dating difficult. Cassidy and Tony begin a banter about what Tony's focus is, she hands him what looks like a compact and tells him its a mirror. Tony pops it open, and finds birth control pills, and won't give it back. He wants to know who she is dating. Cassidy pins him on the desk, tells him about her boyfriend lawyer Bob, and makes him give the pills back.

McGee has arrived and apparently doesn't know who Boone is, so he and us get an update. Boone killed 22 women but only 5 bodies were found. His only mistake was killing a petty officer, which got Gibbs involved, and him caught. He is to be executed on Saturday, but wants to talk to Gibbs first. Gibbs comes in and is very displeased that Boone is up on the plasma. Tony tells him "She did it." Gibbs does not intend to meet Boone, however the Governor wants him to and the SecNav orders him to. It is obvious Gibbs and his team are still hurting from the death of Kate. Cassidy can't sit at her desk and Gibbs is a little harsher than usual with her, Tony explains that it's been a tough month. Cassidy tries to get Tony to talk about Kate, he of course turns the conversation to how Bob is in bed.

Boone's lawyer introduces himself to Gibbs on the way to the cell. His lawyer is trying to get Boone a deal for telling where the bodies are. Gibbs gives Boone 2 minutes to talk. They seem to understand each other. Boone knows what buttons to push. He asks Gibbs how the wife is (ex #1 ?), and points out that she left him. Boone feels that Gibbs has changed, more abrupt now. Boone brings up Kate's death and Gibbs leaves. Ducky is worried about Gibbs emotions getting out of hand with this additional stressful case. When the case originally transpired Gibbs took it very hard.

The team is called out to Boone's old farm house, Gibbs asks for Cassidy specifically. When they arrive Gibbs takes her measurements, Tony is quick to offer them up, he intends to shove her up a chimney. While at the truck McGee wants to know if they have in knee pads (Cassidy stands on his back in the chimney). Tony tells him that Kate is in charge of inventory, ask her. Very sad :( In the chimney they find a scrapbook full of Polaroids of Boone's victims. They had been tortured, tied up, tongues cut out, and hearts carved into their backs.

On Gibbs second visit to Boone his autobiographer is there. Boone knows Gibbs has the scrapbook before he mentions it. The writer is very excited that it has been found and wants to look at it. So does Boone, then he will tell where the bodies are. Gibbs tries to needle Boone with comments about his prostitute mother who ran out on him as a kid. It doesn't work and Gibbs says he's not playing Boone's game anymore. Gibbs has Boone transferred to NCIS in an attempt to throw Boone off balance.

Abby is finding IDs on the 27 victims in the scrapbook. She IDs the first victim, disappeared in 1974 when Boone was still a kid, as his mother. The last 4 victims she is unable to ID yet. McGee has the idea to use the geographic landmarks in the photos to search satellite images and find the location.

Gibbs is observing Boone in interrogation when Ducky comes in. Ducky warns him that Boone will never tell him where the bodies are and that this case has already hurt him enough. Tells Gibbs that he lost one relationship, a wonderful girl, because of this case. Gibbs gets angry and says she left me. Ducky retorts that he made it impossible for her to stay. Gibbs goes in with Boone and Cassidy comes over the intercom. Boone says it sounds like you replaced your dead female, can I meet this one. Boone's lawyer shows up and wants to have a confidential conversation with Boone, no mikes.

Tony, McGee, and Cassidy go to the dumping ground that McGee and Abby located. At the site they find bones and then another body. Cassidy treks back up to the truck to call Gibbs. She is being watched through binoculars. While she is gone McGee realizes that the dead woman is pictured in the scrapbook. They wonder how that is possible she's only been dead a few days and Boone has been in jail. Gibbs congratulates Boone on getting him to play the game. Boone says he is the only one who can find the new killer, they can't execute him now. Gibbs says he doesn't care, they will find him without Boone's help.

At the truck Cassidy is struck from behind and kidnapped, a Polaroid is left behind for the team to find. The team go into overdrive to find her, as Abby says "we cant lose another agent, I cant take this." They consider the biographer, he has a record. Meanwhile Cassidy is in the trunk of a car. The scene is shot to look like she is in the biographer's car. Gibbs asks to find out if his mobile has a GPS locator. McGee says he does and he has already homed in on it. Abby and Gibbs both praise him at the same time. Gibbs and DiNozzo is on chase and manage to cut him off but they only manage to catch him but Agent Cassidy is not there. On a different location we see Boone's lawyer take the tape off Cassidy's mouth and start taking her pictures.He was not Boone's lawyer by accident. He starts to torture her, says Boone wants Gibbs to remember him for a long time. It cuts to Gibbs and Boone in interrogation as Cassidy fights for her life. Gibbs is threatening to burn the scrapbook unless he tells him where she is, Boone knows he can't. Boone is taunting him trying to push Gibbs to kill him (and thereby ruin his own life). Gibbs pulls the gun and fires but no rounds. Gibbs walks out while Boone tells him she will die. Cassidy proves him wrong as she is at NCIS, she won the fight.

New Character Development / Insights:
  • Tony on handling Kate's death: 'Same way I handle everything: Try not to think about it. …there's always junk food."
  • Ducky about Gibbs: Ten years ago, Gibbs was a very different man. A lot like DiNozzo is now.
  • McGee finds the skulls and Tony does not insult him



Funny Moments:
  • Abby trying to get McGee's attention by saying she is pregnant , probably even with twins and the father maybe Gibbs. Tony is horrified but McGee is undisturbed.
  • Gibbs leaving interrogation and showing that Cassidy is alive and Boone is yelling at him as he is being brought back to prison.
  • When Cassidy pinned Tony to his desk.
  • Ducky talks to Tony about Cholesterol and takes away his pizza because his last blood test was bad.



Trivia:
  • This episode features the first appearance of Stephanie Mello as the NCIS Tech Cynthia Sumner, a recurring character.
  • This is the only episode this season that Cote de Pablo does not appear in.
  • The serial killer's file number on the file reads "H1 J3551CA" or "Hi Jessica," which was referring to SA Paula who was played by Jessica Steen.
  • Boone was captured in 1995, assuming Cassidy was 21 as a junior she would be 31 now.
  • Gibbs had a wife in 1995 according to Boone and alluded to by Ducky.
  • Boone's only mistake was killing a petty officer and Gibbs caught him.
  • Boone's first victim was his own mother when he was a kid and this was in '74 when she disappeared and that is nasty of cutting a girls tongue out and keeping it. So nasty and sick!

        Synopsis:
        Ernie Yost, an elderly Marine veteran and Medal of Honor winner, confesses to murdering his best friend almost 60 years ago in a war battle and the NCIS team's job is to solve all the secrets and save Ernie from prison.

        Episode Recap:
        A former corporal, a Medal of Honor recipient from WWII, came to Gibbs claiming to have bashed his buddy, Wade Kean, to death while serving on Iwo Jima. Gibbs, of course, doesn't believe him and investigates it just to humor him.

        Cpl. Yost began reporting the murder to 911 and no-one believed him. All of the self-blame for his buddy's death began when his wife, Dorothy, passed away. Cpl. Yost is grieving for the loss of his wife, he waltzes with Kate for the memory of her and it is one of the most touching scenes to have been aired. To see the old gentleman crying was so sad.

        Gibbs attempts to let Cpl. Yost go home but is stopped by the confident and alarmingly professional Lt. Cmdr. Faith Coleman, played so wonderfully by Alicia Coppola. She is ordered to prosecute the Cpl. which nobody wants to happen especially Gibbs. Gibbs is not prepared, on any level, to let the Cpl. go to his grave carrying a guilt that he didn't deserve.

        When the team goes to unearth Cpl. Kean Gibbs asks for a team of Marines to come by and honor the unearthing of his body.

        Gibbs tells Tony to take the Cpl. home and to stay with him which is where Tony uncovers some awful evidence. Wade and Dorothy had been high school sweethearts. Could the Cpl. have been so jealous of Wade as to kill him so he could marry Dorothy?

        In autopsy, Ducky points out that Cpl. Kean had lost both legs below the knee to a land mine. However, his skull does show blunt force trauma that roughly matches up to the butt of the gun that Ernie Yost claims to have bashed Kean's head in with. It starts to look like Yost did kill Kean.

        Yost was telling Tony, Tim, & Kate about the music that him and Wade use to like. Then he asked Kate if she dances and answered yes and he grabs her and starts singing and dancing with her. Tim and Tony were enjoying it along with Kate while dancing with him she started tearing up.

        Abby and McGee do a computer simulation of various phases of attack on Iwo Jima. They start with Mount Suribachi, but Gibbs cuts them short and tells them to get on with the specific movements of Yost and Kean and their team. As Abby describes the position where Kean died relative to the position where Yost fought the Japanese off alone, Gibbs takes special note of the locations and realizes something.

        Gibbs, with a few tricks up his sleeve and the help of a former Japanese Imperial Army Lieutenant who runs a local sushi shop, helps the Cpl. to remember what happened. In a heartbreaking memory, Kate, the Cpl. and Cmdr. Coleman end in tears. As Yost relives the scene, he gradually recalls that Kean was in severe pain from the mine attack and was whimpering and moaning. Japanese troops were moving nearby, and Kean's voice was putting the entire team at risk. Yost hit him in the head to knock him out so that he would be quiet, saving the rest of the teams' lives.

        Watching this, Cmdr. Coleman decides to report to SecNav that "Cpl. Kean was killed in action, not by Yost,"

        In my opinion, one of the most touching moments was actually when Cpl. Ernest Yost and the Japanese Lieutenant eat sushi together and the episode ends on them raising their glasses to each other.

        New Character Development / Insights:
        • Cpl. Yost's late wife was high school sweethearts with Yost's pal Cpl. Wade Kean
        • Gibbs is willing to go to great lengths to protect and honor a military hero, with even more determination than he would usually defend someone's innocence. This is especially apparent when Yost begins to look very guilty.
        • Yost's photo with threee of his buddies was two days before he got hit in the chest and when he opened his eyes on Oahu, he saw Dorothy and it was love at first sight.

        Funny Moments:
        • Gibbs, Kate and McGee telling Coleman that Yost escaped and how he did it.
        • Gibbs asking Kate to get Cpl. Yost's ID tag # but Kate looked at him and said that how could he remeber it he's 82. Then Gibbs asked Yost for it and got it.
        • Ducky telling about his uncle William who used to apologize for being naked while he was dressed during dinner but his aunt Gertrude being really naked.
        • Ernie Yost asking Yoshida, "You weren't really on Iwo Jima, were you?" Yoshida understanding enough English to break into a big smile and say, "No. Guadalcanal."

        Trivia:
        • Gibbs striking matches one after the other to create the smell of sulphur, since Iwo Jima was known as sulphur island, to help Yost recall what happened.
        • They all felt moved even Lt. Cmdr. Faith Coleman, who is usually a stickler for rules come what may.
        • Tony gave Yost a foot massage in the squad room.
        • Charles Durning was nominated for an Emmy for his guest turn on this episode.
        • Incorrectly regarded as a error: When Lt. Coleman and the MPs arrive to arrest Corporal Yost, DiNozzo pulls back his tie to display the Medal of Honor hanging from his chest. All three stand at attention but only the MPs salute, Coleman does not. By tradition a Medal of Honor recipient is saluted by all higher ranking officers/enlisted personnel, as well as those below him/her, unless the military person is without cover , i.e. bare-headed, as Coleman is.
        • Both David McCallum and Mark Harmon cite the graveyard sequence with the Marine burial squad as the episode that touched them personally the most. This was in the cast round table discussion in the special features of the Season Four DVD.
        • Charles Durning was not a marine when he served during WWII, he was in the army and was at Omaha Beach. Still has a machine gun or rifle bullet in his hip when wounded in combat.
        • While Corporal Yost wached video, Yoshida spoke Japanese. He said "For the emperor","We comitted a strategic error", "That was good" and "I'm hearing some noises." in Japanese. And When gibbs and Corporal yost are at sushi bar, Gibbs said "motto sake kudasai". It means "More sake, please".

              2.06 – Terminal Leave

              Synopsis:
              When an Iraq veteran is threatened by a group of terrorists, the NCIS team steps in to protect her. While trying to convince an FBI Agent to help them, the team is convinced that they've discovered the bomber. However, things might not be what they seem.

              Episode Recap:
              A woman (Miki) is rolling a shopping trolley back to her car in the carpark. A woman calls her over and they greet each other and hug. As they are talking, Miki's trolley rolls away towards her car. The trolley hits the car and the car explodes.

              Opening credits

              Miki's car is being hosed down as the NCIS truck pulls up. Gibbs gets out with his coffee and cap in hand. An FBI agent tries to stop Gibbs from entering the crime scene. He gives her the stare, and the agent says "Gibbs. You must be Gibbs. Fornell's mentioned you." "Did he?" Gibbs says, and they discuss the possibility of a terrorist attack. Lina (the FBI agent) points towards Lt. Cmdr. Miki Shields, who is getting patched up by an ambulance officer. It turns out Miki was cleared after a hearing for accidentally bombing Iraqi civilians. Lina says that FBI handles the investigation, and NCIS protects the intended target.

              Gibbs tells Kate to track down Miki's family, Tony to secure Miki's home and McGee to coordinate feeds with MTAC. Miki is talking on the phone as Kate comes up to her. They talk until Miki's husband runs over and hugs Miki. It turns out that Libby, the family dog was in the car and was killed.

              Gibbs tell Lina that Miki is on terminal leave, and that in 4 days she will be a civilian and he will no longer be able to protect her, so that's how long the FBI has to solve the case.
              Gibbs is helping Abby, he manages to see the bomber in the grainy picture. Ducky autopsies the dog and finds evidence he sends to Abby . The team has been assigned protection detail, McGee is the eyes in MTAC. Tony tries to bond, not good with kids. Abby calls Gibbs to tell him the evidence proves it was a bomb with the same signature as an Al Qaeda bombing.

              At the bullpen Lina tells Gibbs that the FBI has identified 3 possible suspects with Al Qaeda ties. Khalib Hassan is a suspect in 3 other bombings. Roland Moore was a petty officer but is now on the NCIS most wanted wall. He lost 2 fingers as a marine, then blew up a recruiting office and escaped from prison. He is posting threats. An ice-cream store owner who really launders money for Al Qeada.

              The next morning Tony invades Kate’s space by brushing his teeth while she is in the shower. She throws a wet sponge at his head when she realizes he is there. That day Kate shadows the temperamental teenage daughter at high school. While the bratty son kicks a soccer ball at Tony’s head, Tony later taunts him for not making a goal. During the game the parents squabble and Gibbs spots a groundskeeper it doesn’t feel right, zoom in to see 2 missing fingers. That night the kid plays an online game with McGee, who worries that this is not what MTAC was intended for. Gibbs catches him and the kid wins.

              The FBI has collected photos from the ice-cream suspect’s computer. They are of Cmdr Shields and her house. They wont pick him up though because they don’t want to tip him off. They are hoping they will lead them to the rest of his cell. Gibbs worries about the FBI taking over the protection detail when the four days are up.

              Later in the night Tony and Kate move in on someone in the backyard. But then hear a thud from the daughter’s room. Her boyfriend has snuck in and is almost shot by Kate, Tony, and her mom. The parents have a “chat” with their daughter while Kate and Tony have their ears pressed against the door. Her daughter is upset that mom has been away, doesn’t even know the boyfriend’s name. Her dad jumps to mom’s defense but the daughter wants to know why he cares about mom’s feelings all of a sudden.

              Abby and Gibbs are able to pull a reflected picture of the bombers hand off the car. A hand with only 3 fingers. The Cmdr. wants to go on a run, it brings up some tension with the husband, Kate and Tony are to go with her. Gibbs confronts Lina about not picking up the suspect, saying it is putting his agents at risk. Tony notices a white van is following them on the run, they break from the path just before a car bomb goes off. The vans turn out to be FBI, they did not notify NCIS that they are using the Cmdr. as bait. A family friend shows up to find out if the Cmdr. is OK, wants to visit her.

              Gibbs threatens to tell the news about the FBI’s tactics if he is not allowed to interview Moore. Lina caves. She arrives to observe the interrogation but Gibbs is “prepping” the suspect. Gibbs has taken Moore down to autopsy. He and Ducky discuss and demonstrate how he will be autopsied after he “hangs” himself. Gibbs gets the names of the rest of the cell.

              As the team is driving away from the house Abby calls to say that the second bomb’s ID is not the same as the first, its amateur. Cut to the husband ending his affair with his neighbor. The Cmdr. arrives and the neighbor draws a gun on her. The Cmdr then draws her gun with the team at the door the Cmdr shoots the neighbor in self defense.

              New Character Development / Insights:
              • Kate cant sing, but does so in the shower anyway.
              • Tony has a hard time bonding with children.
              • The kid thinks McGee is great though.
              • Kate was occasionally up to no good in high school: "Erasable ink has always worked for me"
              • Perhaps Gibbs' complete lack of tech skills, is exaggerated on his part (he knew how to screw up the memory stick)



              Funny Moments:
              • The whole bathroom scene with Kate and Tony.
              • When Kate and Tony are listening at the bedroom door.
              • Abby punches Gibbs in the arm and he smiles, no one else would get that reaction.
              • At the soccer game the kid purposefully kicks the ball at Tony's head. Tony later taunts him for missing a goal, gets some shocked looks and quickly apologizes.
              • Gibbs smiling after removing the memory stick.
              • Tony complaining about giving the kid his sunglasses, they were a special order, McGee says he never special orders, the car is in a massive uturn – the ending, then back in the car – McGee says, yes he special ordered once, Gibbs smiles, Kate laughs.



              Trivia:
              • Kate's high school locker combination is 22-14-22.
